Privately Owned Used Cars For Sale

Q.I recently purchaced a privately owned used car and it is having problems. The guy who sold me the car misrepresented is and sold it to me under false pretence. Now I want to return the car for my money back and he is giving me the run around and telling me lies like he's out of the country and he doesn't have the money. When I purchased the car he said it haden't been in any accidents and he up kept the car. I purchased a carfax report after i purchased the car because I didn't want him to sell it to anyone else, and found out it was in a front end collision and received major damage. He also did not up keep the car because when I had it inspected it was low on all of the fluids and the engine was starting to suffer. I'm not exactly sure what to do. I'm thinking about taking him to court, but i'm not sure if this falls under any Maryland Lemon laws.SO can anyone in the group help me please?

A.The Maryland lemon laws do not apply to used car purchases. It's the buyers responsibility to research a given vehicle prior to purchasing. If you take him to court, unfortunately, you will have no case against him. It is not illegal to sell a car that has been in an accident or low on fluids so unless he put a guarantee in writing, you will waste money going to court. Lemon Laws only apply to new vehicle purchases. You may be able to take him to small claims court, but I doubt you'll get anywhere. You may be able to try to sell it to someone else or take it to an auction to try to recoup some of your lost funds and do some smarter shopping next time.
